Peneaha Te Mahauariki sworn. I belong to Ngati Pari and live at Otaki I claim to succeed to Kiharoa on behalf of my brothers Hakopa and Aperaima he was the elder brother (the deceased) he left no will he had no children.

Objectors challenged. Ema Hikakara applied to have an interest as she was sister of the deceased.

Succession order in favour of Hakopa Te Mahauariki, E Paraima Te Mahauariki and Ema Ihakara. £1:0:0

Katihiku No.2 (Adjourned claim)

Hari Wirikake

Hape Te Rangitewhata objects to have 25 __ cut off the western side which was agreed to by Hare Wirikake. Wereti being unable to point out his claim his name was struck off.

Hopepa Hinerau not being able to point out his claim his name was struck off.

Maka Pukehe sworn. I belong to Ngati Turanga I live at Otaki I give evidence on behalf of Hera Tuhangahanga she has in interest in this land her brother Parakaia used to cultivate there on the southern portion of it he was the first who cultivated there, he and Aperahama. I asked for a place from Aperahama for me to cultivate upon he told me had no place but I was to go to Parakaia and he pointed to us the place which is claiming by Hera and we cultivated there. I was a child at the time Parakaia was Hera’s brother after I left there Mary and Jack Harvey cultivated on it. Afterwards Hera and her husband built a home on this land they lived there up the time of her husband’s death in 1872 when she left towards the end of 1872. Hari came from the north he proposed that all the Ngati Turanga should survey their lands. We all went over the boundaries and Karepa matched the survey on the south side. We agreed at the time that this land should, should be included in this claim we were all invited he made no objection it is only now he is objecting. He was a Ngati Turanga at the time of the survey now he calls himself a Ngati Huia his name is included in awards made to Ngati Turanga.

(Cross examine by Hari Wirikake) I was your companion at the time of the survey Papa Tuainuku is a different place from this. The land I claim on behalf Hera was Parakaia’s own I don’t know that Rarangi had a cultivation of H__ there Pukererauhe is not in this claim.

I don’t remember when Parakaia commenced working there he made no objection to us Parakaia worked along with Aperahama I don’t know that it was after Parakaia’s return from Manawatu he worked there it wasn’t through Aperahama’s permission we worked there.

Mere Hawea sworn. I belong to Ngati Turanga I live at Katihiku I have lived at this place as Maka stated Hera has worked there as were__ she has a right there through Parakaia her brother.

(Cross examine by Hari) I do not wish to admit Hera or Maka onto the piece cut off for me.

Penehira stated if his claim was inside the northern fence line he would withdraw. Penehira withdrew his opposition. Decision reserved until the lawyer has an opportunity of going on the ground.

Tawaroa No.3

Kirihona Whamaro and others

Kirihona Whamaro sworn. I belong to Ngati Huia I claim this land on behalf of myself and others the land has been surveyed the names of those interested are Hame Manahi, Nepia TeRau, Kirihona Tuhera, Ana Kirihona I claim through my father he is buried there it was a cultivation of his.

Objectors challenged, no objections.

Katihiku No.2

Ramari Tame Hawea claimant

Hapi Te Rangitewhata (appears on claimants behalf) sworn. I hand in a list of owners of this land Ramari Tame Hawea, Hapi Te Rangitewhata and Tamati Rupuha are the owners. This land has been surveyed it belonged to my grandfather. Ramari’s house is on the land I have cultivated upon it Ramari lives there now. This is the correct plan which I now produce there is one small conjunction between the West boundary and Katihiku No.1.

Objectiors challenged. Manahi TeHimu and Tiaki Hawea appeared and claimed to be admitted.

Manahi Te Himu sworn. I belong to Ngati Huia and live here at Katihiku not on this piece I have cultivated on this land along with John and Thomas Harvey (h.l) We worked there for 3 years Ramari occupied T. Harvey’s house after his death.

(Cross examine by Hari) It was through me that T. Harvey worked there it was not through his marriage with Ramari.

John Harvey (h.l) sworn. I belong to Ngati Huia and live at Katihiku I claim along with Manahi it belonged to my parents. They occupied there from the beginning years ago I have cultivated upon this land I never was interrupted or warned off by Ramari’s people, Ramari is my sister in law we all worked together. There is a wonderful house on it where we used to live I did not work after my brother’s death I can point out the place where worked.

(Cross examine by Hari) I do not know that you are the principal claimant to this land. It was through Piahana we cultivated there he was a nephew __. You asked Piahana for this land he said he could not for I have already given it J.T Harvey this was before the house was built I don’t remember the year the house was built I don’t remember the year when Piahana made this statement.

Adjourned til afternoon.

Hakuai

Peene Arama sworn. I belong to Ngati Pari and live at Otaki I claim this land. This is the plan which I now produce the people who claim with are Peene Arama, Waiata Karaha and others we have cultivations there our sheep are on there.

Objectors challenged, no objectors. After this an objector appeared Maka.

Maka sworn. I claim a portion of this land the western boundary takes some of my land in.

Adjourned for the present in order that the surveyor may visit the ground and report. Court adjourned until 2.30.

Katihiku No.2

Having anything to do with this land I heard that that Ngakuku and Piahana cultivated on this land. They occupied in the same manner that all the Raukawa did Ngakuku slept with his mother. It was Tau Hawea that went to you and Piahana first.

Rakapa Topeora sworn. I know the land within the fence. I worked on it through Potaua and Ngakuku. All that Te H__ has stated is__. I consider that Harvey has a claim through Piahaua and cultivated Hine through them Ngati Huia were not there I only speak of the part on which the house stands. Tom Harvey cultivated on the land last.

(Cross examine by Hapi) I worked on this land and outside of the fence as well. I heard that Te H__ allowed you a right in this block. I do not know who it was allowed Tom having his house to be put up.

Katihiku No.2, 2A

Two certificated ordered in favour of (1) Ramari Tame Hawea, Hapi te Rangiwhata and Tamati Rupuha. £3:0:0 (2) Tiaki Hawea ”Katihiku No.2” Tiaki Hawea for the portion inside the fence. £2:0:0 No restrictions.

Katihiku No.4

Karepa Kapukai, Akuhata Kapuai an and Honiana Ngapuke claiming.

Karepa Kapukai sworn. I belong to Ngati Huia and live at Otaki, I claim this land. It has been surveyed, I produce the plan I cultivated on this land in 1858. Previous to that time it belonged to Honiana Ngapuke. I have cultivated on it ever since 1858.

Objectors challenged. Nepia Te Rau applied to be included to succeed Honiana Ngapuke. Admitted by Karepa.

Certificate ordered in favour of Karepa Kapukai, Akuhata Kapukai,Nepia te Rau, Mihaka Karepa, T Hemana te Tewe, Poni Wahio, Penehua Rangitiora, Tiaki Hawea, Mere Tiaki Hawea and Hiawamu Manahi te Humu.

Pene Arama sworn. I belong to Ngati Pare and live at Otaki I claim this land it has been surveyed I knew it on the plan which I produce. It was given to me Miriama I asked her for it she is related to me she is away but some of her relatives are here. Her claim was __ her __.

Peene Arama and other claiming.

Peene Arama sworn. I belong to Ngati Pare and live at Otaki I claim this land it has been surveyed I produce the plan. This land belonged to Kingi te Ahoaho my mother slept with him and I lived on this land he having left it when after her death Rawiri Te Wanui and Te Kingi’s relatives acknowledged me as the owner. I have lived on this land from my childhook. I have always been cultivating on it and __ now.

Owing to the evidence of the elements the claimants not being able to appear the court was obliged to adjourn till 2pm.

Teimi Ranapiri applied for further adjournment till 10am on the 27^th April on account of absence of many persons who might be interested – owing to bad weather.

The court adjourned accordingly at 2.15pm
