Mr Harper attended with Peehi Parata and Utauta Wi Parata relative to the disposal of part Section 46. Explained that Mr Elder wanted to purchase the share of Peehi Wi Parata and Utauta Wi Parata for the purpose of securing a road into Section 77. The court pointed out that the section originally belonged to Unaiki Wi Parata and at her decease it was allotted to some of her children seven in all, a share would represent about 5-1-28 each. It would need over 10acres to secure a right of way into No77 the half of that area would be ample for the purpose. The owners of the other land i.e. those who wanted to sell did not possess much land, consequently it would not be possible to allow them to sell very much. Unaiki’s family had little or no land of their own, the land they held was derived from their mother. The following lands were formerly owned by Unaiki Parata at Waikanae and Himitangi and descended to her successors.

The court pointed out that the section ought to be subdivided so far as to fix the position of the several shares, as it might happen if this was not done that the purchased shares might be located in an unsuitable place. Mr Harper asked that the application be postponed until he could write to Mr Elder about the points raised.

E The 30th being St Andrews day a public holiday it was decided to adjourn till the 1st December to enable some of the work in arrears to be got on with.
