I claim this land. It has been surveyed I produce the plan – plan tracing.
The court being in doubt as to the certificate by the D. Inspector of surveys thought it advisable to take time to consider the question of the certificate by the Dep. Inspector. The one in this case being approved subject to amendment upon resurvey.
J. W. A. Marchand
D. I. S.
Court adjourned accordingly till 2 o’clock pm.
The interpreter read out the 71st section of the Native Land Act 1873.
Mr J. Booth District officer then said, My ---- to you the court is that it is not clear that these claims should be ---- gone on with because the deputy inspector says that he approves subject to amendment of boundaries after resurvey the pegs having been disposed.
I therefore say that there is no key map of this township and the places adjacent there to enable the court to entertain the cases that are advertised. The present Dep. Inspector has only commenced his work during the last six or seven months and he has seen that the claims conflict and so he asks that a resurvey should be made. I have represented this to the government through the Deputy inspector of surveys.
I promise that the government will resurvey all the blocks which have been thrown out on account of insufficient or incorrect survey. They shall be surveyed free in all cases where the surveyors shall have been paid in other case the money shall be paid into court or made a lieu. I am very ---- on account of Ngati Raukawa who have paid for the survey. It is not the fault of the court. The government will have a resurvey made within the next three or four months and when the surveys are certified and sent to the court a sitting will be held as soon as possible.
Afterwards I wish to say to the court that one of your named Eru Tahitangata had written to the Ngati Raukawa tribe to say that the government favours their case surveyors but throw out all surveys made a Private surveyors. This letter asks that all government work as regards the court should be stopped and that it should be done by runanga.
Letter from Eru Tahitangata read – A.
Letter from Ngati Raukawa read – B.
The government have no idea of any deception respecting this land. They only want to have the proper surveys put in and approved. The government will survey these claims that have been ------- and surveyed without any expense these the survey of which has not been paid for the money will have to be paid into court.
The court approved of the representation of the district officer.
