Awahuri Manawatu A – Subdivisions – continued - Te Kawakawa Te Rotonuiahau and Te Ruahine

The court was asked to define the respective interests of the claimants not to subdivide.

The court was of opinion that the application should have been made under the Act of 1878 but the application should not have been sent in to ask the court to subdivide when in reality they want the individual interests defined.

As the crown grant can not be produced, the land being under mortgage and that the application for subdivision of interests must be made under the Act of 1878.

Claim – Dismissed.

Mr. McDonald on behalf of the tribe asked that Tapa Te Whata be appointed. He being the chief and nearest relation.

Himiona said he was uncle and insisted on being appointed.

I am district officer.

I am intimately acquainted with the land transactions. I recognise this agreement which was produced at Native Land Court at Foxton.

(Mr. McDonald admitted that Tapita and Hanapeka were nearest of kin).

I know the three tribes – Ngati Kauwhata, Rangitane and another (hands in agreement).

After a great deal of discussion, it was shown that Tapita and Hanapeka were nearest of kin. Mr. McDonald had failed to show to the court that there were anyone else nearer in blood.

Order made in favour of Tapita and Hanapeka in equal shares as tenants in common.

I live at Oroua.

I belong to Ngati Kauwhata. I knew Maraki. He is dead. He died about 5 years ago. I saw him dead. He left no will. He had no children. He was my third cousin. I claim also for my cousin.

I consider that these children should succeed with me.

Order that Hepi Te Wheoro, Tapa Ahitana, Makareti Ahitana, Mihi Rangi, Te O Ahitana and Rangitapuke succeed to the interest of Mata.
