I live at Otaki and belong to Ngati Kapu – a section of Ngati Raukawa.

I have seen the plan and recognise the land the portion to the north of the road belongs to me a2 – r2 – p35.

The portion to the south belongs to Rutene Pehiohonoa. I have purchased this land from anaru Hiretaunga that is my title. Rutene is nearest of kin to Anaru who is dead.

Objectors challenged.

I live at Otaki and belong to Ngati Kapu.

Heretaunga was another brother of mine. The applicant is a brother of mine and the land belonged to our mutual father.

After Haowhenua, this land was cultivated. The cattle were given to us in payment for damaging our wheat by Renata Tupuna. Riria’s claim is through Wairaka whose house stood on this land.

I claim on both sides of the road. In the ancient times, the land was cleared. It was subdivided. It was afterwards brought before our own runanga. A line was cut.

The portion now before this court was adjudged to me and I think Naihi should have been in. He (himself is the cause of any division), Heretaunga had an interest in a portion. We all united in working on this land. We kept on working on this land prior to Christianity being introduced. There is no one residing on this land at present. We all derive our title through the same ancestor.

I live at Otaki.

I have a claim on portion to the south of the road about ¼ of an acre through ancestry. I have worked on the land. My father was born there. I have ceased working long ago.

After I had left it, I heard the others had sold to a white man. I am sort of grandchild to Waka and Naihi.

Court stated that it was of opinion that Riria had no claim and was of opinion also that Nahora and Naihi were equally entitled.

I live at Otaki and belong to Ngati tukorehe – hapu of Ngati Raukawa.

I claim this land which is shown on the plan. Part of this land was given to me by Hone Te Tihi. The other portion was purchased by myself and another. We paid by money and horses. Another portion was given to me by the children of the person who purchased with me.

My father gave a portion to Reone not to Teima. Part of the land at the back of Seymour’s house belongs to me. It belonged to myself and my parents.

I have lived on the land. It belonged to my ancestors formerly and then fell to Seymour. I have cultivated on it. I heard that Seymour had given a horse and money for a portion which was sold to my father by Reone.

I live at Otaki and belong to Ngati Raukawa.

I know this land as shown on the plan. It belongs at present to Tamati Tima and the children of Reone.

I know how you obtained possession of this land. I know the portion given to you and Meropa. The south portion was given by Haimona Hiwhenua to Tamati Tima and Meropa. Riria heard about this and did not object.

Seymour then built a house and fenced the land and no objection was ever made to him. This is the first time Haimona has gone to Waotu and he has left behind a document assenting to his giving this land. It was written at a public meeting at Ohau. Seymour and Reone bought the east part from Te Ripaihua. Seymour bought his share with money £3. Reone gave a horse in payment for his part. It was bought a long time ago and I never heard of anyone disputing his right and now Reone is dead.

I think the land belongs to his children and Seymour.

Court threw out the claim of Riria.
