Tamihana Te Hoia sworn.

I belong to Ngati Huia and live at Parutauwha. I claim this, I and anyself and the children of Wi Parata who is dead. I recognise the land as shown on the plan before the court. The land was given to us by our father Te Huia. It was land he had cultivated.

Objectors challenged

Repari Whanaki appeared and said he disputed part of the claim.

Repari Whanaki sworn.

I belong to Nagti Raukawa, I live at Otaki. I conflicts with the Kaingaraki claim at a previous sitting Wirihana Matene made the same objection to this confliction. The court recommended them to go on to the ground and lay it off, we went out Te Werihana and I and we fixed the boundary as shown by the pencil line on the plan there is a stream there. It did not follow this time but the month is the commencement of the line. The claim was then adjourned to a future sitting of the court.

Pihi Pouroa sworn.

I belong to Ngati Wehiwehi. I know this land I remember it being before this former court. I remember we were told to go on the land. We went Manahi, Wirihana, Matene and Te Pae the conversation about the boundary took place there. I did not hear the upshot of it. Manahi know all about the arrangement. I asked them not to come to any definite settlement until I had seen you.

I belong to Ngati Huia, I live at Otaki. I know this land and remember the case being heard before. We went out on the land __ __ no arrangement. Wirihana wanted to move the boundary line but we would not agree, so no agreement was come to I said “wait until Te Hoia” he didn’t come.

The claimaints and counter claimants agreed at this stage to go and arrange the boundary.

Roera Hukiki sworn.

I belong to Ngati Raukawa I live at Otaki. I claim this land for myself it has been surveyed, I produced the plan the claim was called on but nothing done at the last court. It was a cultivation to my father Hukiki who selected it from the time Ngati Raukawa came here first, he cultivated it until his death and I have cultivated it since. It now sold.

Nehehana Te Paia appeared and stated he claimed the adjourning land and he granted to know if the line was correct.

James Thomson sworn.

I am a licensed surveyor I don’t know that the line of this land conflicts with adjourning land.

Ngahora sworn.

I belong to Ngati Hapu, I live at Otaki. I claim a portion of this land because I cultivated there on the South side of the block. I didn’t see the survey when I heard of it I went to Rohera and asked him to go over it. I pointed out to him what portion of my land was included, he asked me not to dispute the claim but pay more he agreed he said he would give me 3 shillings. The claimant stated he never remembered agreeing to give him 3 shillings.

I did not see your father working in the past I claim they had no claim on mine. Ngahoro then stated he had no witnesses to call.

The court informed the counter claimant that he not made on this claim. Certificate of title ordered in favour of Roera Hukiki, Henare Roera, Hone Kuiti, Kimiwe Roera, Tauhu Roera, Ruhu Roera, Hori Roera, Kereihi Roera and Marara Roera. Certificate not to issue until completion of surveys.

Maungapiharau a4 - r1 - p16

Perenara Te Teure sworn.

I belong to Ngati Hapu I live at Otaki.

I claim this land and it has been surveyed by Mr Thomson. I produce the plan, the __ name is Maungapiharau. I claim it on account of being a cultivation of my parents and family they __ to from the time the tribe came here. It is not that the land Hone Taipua worked on it with permission. No opposition. Certificate ordered to issued in favour of.

Perenara Teure – Perenara here applied to the court to have the certificate of title issued in favour Hoani Taipua. Application granted.

Teime Hemi Ranapiri

Teime Ranapiri appeared and stated the land was not his, he had it surveyed.

I belong to Ngati Huia and live at Pautaura I claim this land I recognise the land as shown on the plan. The reason it was thrown out at the other court was that the principle purchaser was away.

Adjourned at request of claimants until afternoon.

Matini Te Whiwhi sworn.

I belong to Ngati Raukawa and Ngati Toa I live at Otaki, the boundary of Kaingarake surveyed by Te Rae is the correct one. This land was disputed between Matanui, Tuinuka and Te Hoia they had a very big dispute about it. Te Hoia and his people left after. This afternoon, Hoia gave this piece to Hukiki subsequently Ngati Huia returned, there was a Totara tree growing inside the boundary of our land which Hukiki said without authority. Hukiki ceased disputing, afterwards Watanui gave me the whole of this land.

Heni Te Rae sworn.

I belong to Ngati Rawkawa I live at Otaki Natanui pointed out all the boundaries to Matini and included the Totara tree mentioned by him. I am willing to let the boundary to the Totara tree including in on our line.

Court adjourned until 2pm.

The court informed the persons of interested that the price shown between the pencil lines be equally divided. Certificate ordered in favour of Tamihana Te Hoia, Mauahi Te Humu and Te Oti Kerei Te hoia. When a correct plan is sent in to the inspector of surveys and approved by him.

Tutangatakino No.6

Teini Rangipiri sworn.

I belong to Ngati Kapu and have lived at Otaki I know this land and claim it has been surveyed by Mr Thomson I produce the plan it has been approved I claim through my parents. I don’t know exactly but they were hiring in the neighbourhood I have never cultivated on this piece but have done so on the adjoining piece it was adjoined from last court because I knew I should be opposed by Hoeta.

Objectors challenged.

Hoeta Te Kahuhue sworn.

I belong to Ngati Kaahata I knew this land, I claim it. It belong to my parents they cultivated and lived upon it I have also cultivated upon it. The claimant has no claim on this piece but has on the adjoining piece. The claimant here stated he would withdraw in favour of Hoeta as he believed he had a better right than.

Further objectors challenged.

Hoeta stated to the court that he had handed over the land to James Cootes and Hoani Taipua and asks that a certificate may be issued to them. Certificate ordered in favour of James Cootes and Hoani Taipua.

Te Kahikatea

The claimant continued I claim it because I cultivated there and my brother is buried there.

No opposition. The claimant wished the certificate to be issued in favour of Hoani Taipua.

Karepa Te Kapukai sworn.

I belong to Ngati Huia tribe and live at Otaki I claim this land for my father Karanama. I want him to speak.

Karanama Te Kapukai sworn.

I belong to Ngati Huia I claim this land I ordered the survey and now produce the plan. The land belong to my father it was part of the land divided between the Ngati Raukawa, I have cultivated on this land.

Objectors challenged.

Roera hukiki appeared.

Roera sworn.

I claim a certain portion of this land in the west corner I have some land__ of this. I claim this small piece because my aunt cultivated there she stayed there through her brother Hukiki. My aunt’s house was by the side of Karanama’s fathers’ house. I have also lived there with her and cultivated there.

My aunt’s slaves built houses I cannot tell the time she got the land through her brothers Hukiki had a clearing at Waireke to the west of this land. Hukiki’s slaves worked on this land. I have no witnesses to call on my behalf.

Karanama recalled. I never remember a house being built near my fathers.

Hemi Kooti appeared on behalf of Roera Hukiki.

Hemi Kooti sworn.

I have had the my land 20 years some portion of Hukiki’s land was included in it he was the only man I ever had a dispute with I never saw a house on this land.

Hoani Taipua sworn.

I know this land if it is the same as is inside the fence it is Karanama’s all his lands are fenced. The court informed Roera had failed to make out his claim .

Certificate of title ordered to issue in favour of

Karanama Te Kapukai, Karepa Te Kapukai, Akuhata Kapukai, Wireti Te Ruinui.
