Kipa Whatanui

I hand in list of names for Block 3. Whatanui is their chief and is buried there.

Lists assented to for all the hapu’s.

Kipa, Hoani, Piwiki, Hoani Taipua – we want an unrestricted order for Blocks 1, 1A and 4 but restrictions on 2 and 3. All grants as tenants in common.

Decision as in sketch marked “J” and lists – see page 258 etc.

Court resumed at 2 pm.

Kipa Whatanui – claimant

KipaWhatanui said – I claim from my ancestors Matenga Te Matia. This is my survey. I call: -

Paranihia Whawha – sworn

I and Matenga have the greatest right to this land. Tahoro was the principal person on it. His wives were Tima and Whata. They cultivated it in former times but they cultivated ¾ of an acre. The river has swallowed up the place. It is not on this plan. I worked on the piece carried away and on that that remains.

The whole block was cultivated except the swamp and bush. I was not present at the survey. Mahuiainu claim is the side of the bush. He has worked there.

Our main cultivations extended from the river to the pencil lines A, B. Hakaraia Te Reinga had no cultivations that I saw.

I saw Katarina and Hanara working on Tuahiwi on the part carried away. I do not know where Petuha worked.

Pene Arama – sworn

Kipa and I were present when the lines were cut. I cut this North West line to divide my land from Kipa’s.

I only heard that this land belonged to Pari Whakatere and Patukoharu worked on the part swept away. Pikiahau worked outside on the part owned by me. I heard Haimona Mahauariki had a title to this land. The open part was cultivated by Pare who preserved the bush in order to gather Tauhara fruit.

I don’t know how Pukekaro got on this land after his wife died. He came in about 1871.

Hakaraia surveyed the part tinted green on the plan.

My fathers told me that Mahauariki Tuara Te Waharaihi worked on this land and Te Matenga and Pariaihi also. I did not know Hakaraia was objected to. He was Kipa’s uncle.

Ngati Huia’s only objected to the survey. The land from the river to the North West corner has been granted to me. Judge Rogan gave this land to Ngati Pare in 1874. It was cut out of Ngakaroro No. 3.

I did not see the boundaries within which worked Mahauariki. I do not know the special place where he worked. My opinion, Paranihia’s people on the part marked green, Waharaihi worked there by permission of Mahauariki. I first heard of Paranihia being on the land when it was surveyed.

Ngati Pare have let this land to Hector McDonald. Pare receives the rent. Mahauariki and Matenga’s people were of one hapu. I saw Merehira and Puhekaro working on the land. Pare’s sheep are on this land.

Matenga is owner of one part of the bush and Paranihia another . The Tawara’s in the bush are Pare’s.

My land is to the east, west I mean. Ngati Huia to the east. Hanara’s cultivations are within this plan. I did not see Katarina’s cultivations. Some of Pare’s have been swept away. I never heard that Hakaraia worked on this land.

Hapi who conducted the case caused this part to be cut out of Ngakaroro No. 3. I was not present at the survey.

If this is a new survey, it is wrong.

Judge Symonds has decided my land. This is at “e” and “o” on plan W.D. 341, # is Kipa’s, mine is Tuahiwi No. 2. Ngati Raukawa had the great “mana” over the land.
