Application for Partition
Hema te Ao and others applicants
Inia says that when the court directed us to attempt to settle the allotment of the land Hihira asked for 300 acres but Ropata only consented to give us 250 acres. On the second attempt we asked for 300 acres Hema offered us 200 acres. If he had offered us 250 acres I would have accepted that as a settlement of the matter.
INIA HOANI sworn I ask that the proposed allotment made to us whould be increased in consequence of the fact that my mother and grandmother cultivated on the land.
Pare had a mahinga at Kauepango. No Pare te hoiho tuatahi grazed on the land. Te Pakanga that happened on the land was about Hare Hemi’s father. I heard that this land was given to Ngati Pare for the killing of Te Poa te tamaiti o te Rauparaha.
Another trouble was about the sale of stones by Ropata toa. I heard this person spoken of this happened in 1887. The horses on the land were branded in the first place with a brand that belonged to my father and was afterwards taken by Te Puke. 3 of my relatives were buried on the land.
I was born on the land so also was Hakaraia. Hipora was also born on the land.
In 1876 I used to occupy the land was taken away by Ropata te Ao. In 1880 when I got married, I brought Ropata te Ao.
I claim from the occupation of my mother and grandfather and for the tuku to Ngati Pare. It was owing to the occupation of my grandfather that Roera Hukiki was able to retain the land.
Kaware was the place where the rohe was first fixed. The place where my relatives are buried is outside the block now before the court.
Tetahi huarahi wakahaere ko au kei te wakahaere. Ko au te kai wakahaere raua ko Hema mo te moni e toe ana mo nga totara. Hei tamaiti whangai au no Ropata.
In 1886 Ropata te Ao applied to have the interest of Te Puke dealt with. We had a meeting. Ropata te Ao said waiho kia mate eia and he would will the land in our favour. In Totaranui No. 11 Hema put himself and Hipera in that land.

INIA HOANI xd by EMA ROPATA. Part of what I have stated was told to me by my mother and partly I knew myself. I heard that the land was given to Ngati Pare to Te Puke and Te Ao.
No te wakahokinga nga eka kia matou te take i wakatete ai te whawhanga.
If the land had been given to Te Puke and Te Ao I should object to the 100 acres offered to us.
I heard that it was Ngati Pare. I don’t know which of the Ngati Tera gave the land to Ngati Pare. Kiharoa, Wi Piti, Te Puke and others were the ranagatira’s at the time of the tuku.
I don’t know of the tuku to Te Ahukaramu of part of Muhunoa. I don’t know about the tuku to Hare Hemi. If the land was given to Te Puke and Te Ao it would be right for Hema te Ao to adjust the apportionment of it.
Court adjourned till the 8th instant.
