Monday 23rd August 1880
Court opened at 10 am.

Aorangi No. 1
Mr McDonald stated that since the case had last been before the court he had been appointed as a government commissioner as such could not appear if the case was contested.
Dr Buller here stated that his clients Anapeka and Tapita were absent and asked for an adjournment.
Mr McDonald replied at length.
After much discussion, the court determined that the lands in the Aorangi No. 1 that have not been awarded by the court should be vested in the original owners so as to clothe the balance of the land in them with a title.
Court adjourned until 2 pm, in order that counsel may arrange as to the order that should issue.
Court opened at 2 pm.
Dr Buller handed in a memorandum of agreement.
Entered into between them and asked that the court would grant an order accordingly that the court would give effect to the following that is the order made at Palmerston should stand and that the balance of the block be reinserted in the original accepting enereta and 6 others with the promise that the undivided share of Tapita Matina and Hanapeka Matina therein shall be one hundred and three (103) acres, the ---- there of to be hereinafter determined. The court then stated it would give effect to the above recommendation and issue an order as follows – See page 272.
