Teimi Ranapiri – sworn

I purchased this land. I gave a cow and calf to Piripi Rawaraki about 2 years ago. I have cultivated it ever since.

I wish my name and that of my wife to go in the Memorial.

I do not want any restrictions on it. I have plenty of land besides this.

Piripi Rawaraki – sworn

This land was my own according to Native custom. I have sold it to James Ransfield for a cow and calf. I have other lands. This land was my own property.

Objectors challenged.

No objectors appeared to the sale. Everyone agreed that the sale was a first one.

Pene Te Hapuku appeared and objected to one of the boundaries.

Pene Te Hapuku – sworn

The western boundary encroaches on my land. I was not present at the time of the survey. I have since seen the cut line. It is about 7 feet from the tree.

Teimi Ranapiri stated that the tree mentioned by Pene was outside the boundaries.

If Mr Carkeek and I went on the ground we could see that peg and he would see I am right.

Teimi Ranapiri – recalled

Piripi first surveyed the land. I was present at that survey. A number of others were there.

Pene was not an objector. Enoka made an objection to another boundary. Pene never made any objection to the survey.

I was present when it was laid off by us natives. I was not present at the first survey. Pene was there from the time the line was laid off to be fenced which was in 1873. Pene has never have any objection.

Teimi Ranapiri – sworn

This land originally belonged to my wife and two others but since then her mana has been given to her younger sister and Hotene. Riria’s mana has been given to these two and I wish the order to be made in favour of Ruihi and Otene also I want a right of road for myself at the north west corner.

Riria Ranapiri – sworn

I am wife of Teimi. My mana was over this land formerly. I gave it as a free gift to my younger sister Ruihi and Te Otene who is an old man living with me and he is blind.

Teimi Ranapiri

I wish the order made in favour of Otene and Ruihi. Otene has 4 or 5 children. Ruihi has three children.

Objectors challenged.

Enoka Te Whano

Teimi Ranapiri in answer to Enoka said he knew of no writing in which Te Otene had made any disposition of the land.

No objectors

Mr Carkeek asked for lieu of £3.3.0 to be registered. Agreed to be paid.

Adjourned until after dinner for Otene to be seen.

Teimi Ranapiri and Enoka had been to see the land.

Enoka Te Wanu

I went to see the land with Pene. I pointed out where James Ransfield’s peg ought to be. I found the peg which is in the correct place. I told him so. The plough had gone over into Pene’s land. I saw the place where the fence had run and found the peg which to my mind is correct. Pene’s land is included.

The assessor proceeded to deliver judgement which was in favour of Teimi Ranapiri and Riria Ranapiri.

Order made in favour of Teimi Ranapiri and Riria Ranapiri.

Mr Carkeek applied for lieu for survey - £3.3.0

Piripi had paid £2.0.0 for the survey to Alsdorf – chief judge said the survey could be paid for.

Te Otene Ngawi – sworn

I have some children. I do not wish my children to have this land when I am dead. I have my own wishes and can make my will before I die. They have plenty of land outside this.

Ruihia is my neice. She is at Oroua.

I consent that the portion asked for as a road should be reserved.

Order to be made in favour of Hotene Ngawi and Ruihia Matuaharama. Road for carts to be reserved at north western corner

Ohau No. 3 – Succession

Heeni Arama and others claims to succeed Rawinia Tapaea.

Heni Arama – sworn

Rawinia was my younger sister. She is dead. She died about 3 years ago in Otaki. My sister is named Rana. My brother, not a sister, he is older than I am. Rawinia was the youngest. According to Maori custom, the land would descend to both of us and I want an order to myself and him in equal shares. Deceased left no will.

Objectors challenged.

Order made in favour of Rana Tapaea and Heni Arama.

Ohau No. 3

Heni Arama and Hana claim to succeed Ane Tapaea.

Heni Arama – sworn

Ane was a younger sister of mine. She died in 1878 in Otaki. She left no will. I ask that her share should go to her children viz –

Rawinia Rawiri, Tame Rawiri

They are the only two children she had. One is an adult and one is a young – the boy is about 5 years and the girl is about 2 1/2. They are in Waikato. I wish to be appointed trustee with another (Mohi Heremia) to these children.

Order made in favour of Rawinia Rawiri - (about 2 ½) and Tame Rawiri – 5 years

Heni Arama and Mohi Heremia to be appointed trustees for the children.
