Readjustment of acreage in consequence of objections raised by Apaira te Whenua and others against Tarikama haing been allotted 20acres. HAKARIAI TE WHENUA called and exd. I saw him. He asked me what objection and I explained to him that the other relatives of Hingaia objected a to what had been done and f the adjustment then made was not altered they would apply for a rehearing. I wanted him to go to Otaki before the court but he replied that there appeared to be no reason for him to do so as he was objected to. I saw him again afterwards with Akapith Tahitangata and the latter accused me of interfering in the matter. I told Hamapiria that he must attend the court at Otaki on the 30th inst.

Matter adjourned until the other parties could be communicated with and a decision come to as to the disposal of the 20acres.

Appointment of Trustee

Application by Thomas Bevan Senior to be relieved of his trusteeship in respect of the children of Henare Pewene

Applicant appeared also Mr Arthur Drake who stated that he desired to be relieved of his position as joint trustee for the aforesaid children. By an order of the Native land court dated 7th March 1895 under the Maori Real Estate Management Act, the court appointed Thomas Be van Senior of Manakau and Arthur Drake of Otaki Trustees conjointly with Miriama Pewene the Survivor of the Trustees appointed on the 29th July 1889. Both of the Trustees applied to the relieved of the Trusteeship. The court inquired if it was proposed to nominate any one else for appointment in substitution of the retiring Trustees. Thomas Bevan informed the court that his son George Bevan would b willing to accept the position and he understood that Hema te Ao was willing. George Bevan and Hema e Ao both questioned as to whether they were willing to accept the post of trustees for the children of Henae Bevan about to be vacated by Thomas Bevan Senior and Arthur Drake ansered in the affirmative. Ordered in pursuance of the provisions of section 4 of the Maori Real Estate Management Act 1888m That George Bevan of Manakau and Hema te Ao of Otaki be appointed Trustees in substitution of Thomas Bevan and Arthur Drake who have voluntarily retired from the position as Trustees for the infant children of Henare Bevan deceased viz.

Makere Pewehe 19years 7months

Ema Pewehe 17years 7months

Teeti Pewehe 16years 7months

Matiana Pewehe 15years 7months

For the estateand interest of the aforesaid minors in the parcel of land known as Man Kuk 4 E Section 4. And if it hereby further ordered tht the order appointing the aforesaid Trustees made on the 29th July 1889 be cancelled so far as the appointment of Thomas Bevan Senior and Arthur Drake is conversed and that an order be made in lieu thereof appointing George Bevan, Hema te Ao and Miriama Pewene Trustees for the aforesaid minors

Application to succeed to HOANI TAIPUA

Mr Knocks stated that an arrangement had been made between Successors to Kiharoa and the family of Hoani Taipua that a readjustment of the area allotted by the court should be made amonst them. Asked that an adjournment be made to enable all the parties to be present. The court pointed out that the title appeared to have been in a complicated condition judging by the Memo on the papers, owing to a mistake having been made by issuing a Certificate in favour of Moroati Kiharoa for a2 – r0 - p30. This certificate was recently cancelled by the chief Judge so as to allow the amended certificate to come into operation. The condition of the title at the present tme for the block of land known as Te Awamate is that 2 certificates of title under the Act of 188o have been issued in the following manner.

Lot 25 comprising a0 – r1 – p17 – 8 in favour of Moroati Kiharoa Lots 26 to 30 containing 2 – 0 – 30 – in fvor of Hoani Taipua and Hema te Ao

Moroati Kiharoa, Hema te Ao and Hoani Taipua are dead and successors have been appointed to Moroati Kiharoa

1. Matenga Moroati Kiharoa

2. Hihira Pakere Moroati

Successors appointed to Hema te Ao

Viz Hema Ropata te Ao

PITIERA TAIPUA asked the court to allot the interest of Hoani Taipua in the aforesaid section to himself and Umukaihau Taipua.

The court pointed out tht it could not do so in the absence of Tohuroa Hira Parata as he had a right to be consulted decided that the application be adjourned to the 11th instead. All the persons concerned to be present.

Application adjourned till the 11th instant.

Native appellate court adjourned till the 10th instant court adjourned till the 4th instant.
