Court opened at 10 am.

Present – the same

Case continued

Hakaraia Te Wera – sworn

The dotted line is the boundary between Kararaina representing Whatanui and Ngati Huia. Kiriona laid down the boundary at the Lake. Hutana was not at the contest about the boundary. I did not see the survey.

By Tatana

I don’t know that this is Hutana’s. I believe it is Kiriona’s land.

Hutana – sworn

I belong to Ngati Manea. T

he boundary at Wawa and Mangawhati is mine. The proper boundary of the block is at wawa.

Whatanui wanted the dotted line to be the boundary but I pushed it back to Wawa and oo. The 275 acres has become mine.

I object to Tamihana having a right to the north of dotted line. His cultivations were outside. My cultivations were Wawa and Mangawhati. They were eel weirs. No one interfered with me.

Te Rakauwhakamatuku post is on south side of dotted line. I have not seen an eel weir of Tamihana’s there.

By Kiriona

I caused Whatanui to remove his line back to wawa Lagoon.

By Tamihana

Mangawhati is the name of the valley. The line should not run direct from Wawa to Mangawhati.

The line 116* 21 27 is mine. The dotted line was indicated by me with your father and elder brother. It was arranged to be boundary between your land and mine. A part of the swamp is mine and that at Rakauwhakamuku is yours. The dotted line is between us and Ngati Huia. Mangawhati is a river. I have an eel weir at the stream at Mangawhati.

Rangitewhata – sworn

This portion of land is Hutana’s. I know of no other owner.

Xed by Kiriona

You have a right there as belonging to Ngati Manea. I know you contested with Whatanui about the boundary at Wawa. I surveyed external boundaries of 7D to be made.

By court

Whatanui was a chief of Ngati Raukawa.

Tatana Whataupoko – sworn

I and Tamihana were present when Whatanui disputed with Kiriona and Hutana about the line at Wawa. Hohaia came. Hutana was a grown up boy of Hutana’s and Hohaia’s. He contested on behalf of his uncle Pita who is now dead. Hutana is the eldest living of the Ngati Manea hapu. Hutana’s children work on the land. I am married to his daughter.

I fished for eels there (at Mangawhati). No one objected until the survey. Bennett surveyed the dotted line. Ngati Huia agreed to the dotted line as being boundary between them and Ngati Te Manea and it was surveyed.

By Tamihana

We first had contention about dotted line. Afterwards everyone agreed. Te Manea alone should be in the 275 acres. Ngati Tuwhakahewa and Hapapipai have no right on it. Boundary was made by Ngati Huia and us.

By Kiriona

Pita Kaiaho had the greatest mana over the land and it descended to Hutana. There was an old boundary of Tepui outside of wawa Lagoon.

By Court

Kiriona went to take the land for himself not for Pita.

Tamihana Te Hoia

If Teira consents to the dotted line, I will.

Te Irira Te Hinu - (on oath)

The line was first ranged one side and then the other and then in the middle as it now stands. All consented as now shown on plan R.

Tamihana

I consent to dotted line.

Court adjourned at 5.10 pm.
