Licensed surveyor. I proceeded yesterday to the Ngawhakarangirangi land shown on the plan before the court of the Ngawhakarangirangi claim with Meri Kaumatua. I found pegs at the points marked A and B on the plan. The peg at the point A was put in by myself on the survey of the Ahitangutu claim for Henare Hatete and was pointed out to me by Meri Kaumatua as standing upon the boundary line of her claim. The peg at the point B was also pointed out by her as standing on the boundary line of her claim as shown on the plan before the court.

I identified the peg at the point B as marking also the boundary of the Ahitangutu claim.

James Thomson – Sworn

I am a licensed surveyor under the Native Land Act.

I put in plan of the following claims; Te Kahikatea, Whakarangirangi No. 3, Kaiawakura, Te Ahitangutu No. 2.

These surveys have been all made by me. The plans are mine. The boundaries are distinctly marked upon the ground as shown on said plans respectively and the rules of the court have been observed by me. I was employed by the claimants in every case. The boundaries were pointed out to me in every case by the claimants.

In the case of “Kahikatea” Metera pointed out the boundaries.

In the case of “Kaiawakura” Wi Parata pointed out the boundaries, which had been pegged before I went on to the ground. I have heard that Hoani Taipua disputes the ownership of a portion of “Te Kahikatea” claim and I have also heard that he has removed some of my pegs and lock spits defaced. I was not interrupted during any of the surveys and I am not aware of any dispute as to ownership except in the “Kahikatea” claim. I wish to state relative to Te Kaiawakura claim that my employer the claimant Wi Parata is dead and that I have not been paid by him for the survey. My claim amounts to £6 – 0 – 0 (copy put in). I agreed with him – by – Wi Parata to make the survey and plan for £5 and I now claim one Pound (£1) for attendance at court. I look to the party to whom the land may be awarded for payment of my charges. I apply to the court for assistance in payment of these charges. I have reason to believe that Wi Parata had the money by him at the time of his death, and that since then it has been otherwise appropriated. I was promised payment by Tamihana – policeman- at the sitting of the court. An order on Nicholson’s Manager was given to me by Manahi and Te Hoia but it was dishonored. The reason alleged was that the drawers of said order had no claim on Mr. Nicholson’s Manager. I applied verbally to Tamihana, who I believe to be one of the claimants, for payment of my account.

Relative to my charges for surveying Kaiawakura dense bush which is the reason why the charges appear high. I had several trial lines to cut.
