Mr. Upham appeared for Mr. Drake

Explained that all the applications had been previously before the court Cpt No. 1901/59 and this was merely a formal matter for the purpose of giving effect to the direction of the court made in 1898 that Patihona Takaitemarama and Whata Hakaraia should execute a deed of confirmation in favour of Hakaraia te Whena to validate the previous transfer made when they were under age.

Patihona and Whata - present and examined as to their concurrence to withdraw all opposition to confirmation being completed.

Both of them stated that they consented to withdraw their opposition on the understanding that the balance of the purchase money was paid and five years rent.

The balance of purchase money payable was €41.5.0 and the five years rental £6.10.0 per annum would be £32.10.0.

Whata and Patihona consented that the payment of rent should terminate at the time the deed of confirmation was signed.

Confirmation to be granted subject to the payment of the balance of the purchase money and the five years rent.

Mr. Upham arranged to meet Whata and Patihona with Mr. Drake at Otaki on Wednesday.

Receipts for payments to be produced prior to confirmation being completed.
