Court opened at 10 am.

Himatangi
Arona Te Hana having applied to judge to have his name in the Himatangi and the court not having the original deed of session was unable to compare it with the names given in by the persons on Friday.
The whole of the documents with deed of session having been sent for, for examination. The case would stand adjourned until the court returns from Palmerston.
Ohinekakeao – 1043 acres
Neville Nicholson applied for 2 orders one for 300 acres for the five persons and the remainder to the same persons. They having sold 300 acres to Mr. J. Davis.

Proceeded to give evidence as to discrepancy between the original line as surveyed by him and the line as shown on the new survey. He wished before giving evidence to go on the ground and see the pegs as it was many years since he had been there and pegs might have been altered but still as the line as shown on the plan was outside the lagoons. It would no doubt be correct and the new survey shows the line running right through the lagoons.
The principal persons interested agreed to adopt the old line as shown on ----- map.
It was then shown that the plan encroached on takapu No. 2 and includes the whole of No. 1 and also encroached on government land.
