I belong to Ngati Kapu a section of Raukawa.

This is the plan of my land. The land belonged to an elder relative of mine who lived on it and cultivated it his right was never disputed. I wish myself and children to be inserted in the Memorial and to have it restricted from sale.

I live at Otaki and belong to Ngati Maiotaki hapu.

I am related to the claimants and claim conjointly with Eru. I don’t oppose him.

I claim from (click on view to see genealogy line – page245)

The land originally belonged to Matepu and his son is alive.

I was not born in the time of Matepu and could not say if he would have given me land. The land descended to Matepu from Arawaere.

Te Wiata appeared.

I live at Otaki and belong to Ngati Tehoru hapu.

I claim only a small portion.

The court informed the claimants and counter claimants that the court could not adjust the boundary this small piece being situate in the centre of a swamp and some of the land surrounding it had been surveyed if they could not agree amongst themselves the court would have to throw it out.

The court told them it would adjourn the claim for a day or two and if they could agree would make an order.

Te Wiata came forward and waived his claim.

I know this land every one knew that the land belonged to Matapu and Pairoroku they went and settled there when they first came.

Pairoroko is dead and left no heirs. Hoani is the only descendant of Matapu.

It was other land which Pairoroku gave to you. You told me so. At a certain runanga it was decided to give you some of Pairoroku’s land because you had looked after the old man. At the runanga did not give you this land they gave Matapu’s land to Hoani.

I live at Otaki and belong to Ngati Maiotaki.

I knew Pairoroku and Matapu.

After Pairoroku’s death the land went to Matapu only I consider it now belongs to his son I never heard it was given to Eru.

Pairoroku died before Matapu. Pairoroku died after Matapu. Pairoroku was away in Napier and where he came from he lived on the land while he was away. Matapu lived there after Pairoroku’s death the runanga put Hoani on as Matuku’s succession I have never seen it cultivated.

The court stated that it would have to make an order in favour of Hoani Matuku.

Dr Buller appeared on behalf of Mr Wallace and stated that the land had been awarded to Matini Te Whiwhi and Tamihana Rauparaha, Rakapa Topeora, Hoani Te Ororo.

Matini Te Whiwhi – sworn

I have sold my portion 1915 acres I and my co grantees. We obtained the governors consent to the alienability. The portions surveyed off was to go to my grandchildren and Te Rauparaha.

I object to the remainder (640 acres) going absolutely to Rauparaha. The subdivision line was run off by direction of a government officer I never gave my consent.
