I belong to Ngati Raukawa and live at Otaki.

I claim an interest in this land because my hapu cleared it. I never occupied it but my parents did. They cleared it.

I don’t belong to the same hapu as Peene. There was no dispute about the clearing. There is no one on the land. Peene’s sheep are on it.

I can’t point out which I claim. I spoke about Wylder’s survey at the time. I did not see Mr Carkeek surveying the land although I was here at the time.

At this stage the case was further adjourned.

Natana Pipito

I have been on the land. I pointed out to the assessor the portions which Pea has a claim to.

The land originally belonged to Kingi Ahoaho. The woman’s husband was the younger brother of Te Ahoaho and she received the land from him. I was present. Kotuka gave us a portion.

Part of it was inside this land and part was outside.

After this a boundary was laid down between the two hapu’s.

It was on our account that Kingi laid off the boundary. The hapu was called Ngatakiri. It was not for Ngati Huri. The Ngati Huri have no right to the small piece. The old woman has.

The court was of opinion as the claimant and counter claimants could not agree about the boundary line. The original line should be the proper boundary line and ordered the surveyor to alter the plan.

Hema Te Ao, Piripi Kohe, Tatana Whataupoko, Arihia Te Darena, Hipora Te Whioi and Harata Wi Neera.

I belong to Ngati Raukawa.

I claim to succeed Kiharoa. I am Kiharoa’s sister. There are five of us who claim. We are all brothers and sisters. Kiharoa had no children. One of the sisters died leaving 3 children. Atereta was her name.

Himiona Ngarama – sworn

I am a Ngati Kapu hapu of Ngati Raukawa and live at Tararua.

I don’t understand maps. I claim Piritaha. I had it surveyed by Alsdorf and afterwards by Mr Carkeek. I have always lived on it ever since Ngati Raukawa came here.

I use the land now. I have sold the land to Ropata Ranapiri and wish the order made in his favour.

I live at Otaki. I belong to Ngati Raukawa.

This land belongs to myself and others. The land was my fathers and now is mine. I have worked on it. No one ever interfered with me.

Court resumed.

Mr Booth called the attention of the court to the fact that he had been informed by some natives that Ahitangutu just passed conflicted with the Maori road as shown on the original town plan.

Mr Carkeek stated that he never could find a plan (that is a government map) and there was no accurate survey of the town as far as he knew or as to the abandonment of certain sections in Otaki.

Hema Te Ao stated that on the withdrawal or alteration of the road from the original plan and as a deviation had taken place, the land did not abut on the road and no alteration would ever be made. He asked the court to let the order stand.

Pipi Kutia – sworn

I live at Otaki. I belong to Ngati Toa and Ngati Raukawa.

I know this land as shown on the plan. It belongs to me. It formerly belonged to my mother who was a wife of Rauparaha. They occupied the land and named it Rangiuru.

Ngati Raukawa did live there for safety at the time of Haowhenua. It was a permanent place of residence with us and Ngati Raukawa only went there when the pa was built because they were afraid of Ngati Hau.

I claim for myself and family. We lived long before the Ngati Raukawa came there. The land is leased and Hape, myself and James Wallace receive the rents. I have had it surveyed twice.

Objectors challenged.

The whole of the Ngati Raukawa arose to object.

The court informed them they better appoint one person from each hapu to conduct their case.
